1. Return Policy for Audio files and eWorkbooks

Weigh To Health, Inc. has a NO REFUND, NO RETURNS policy on DOWNLOADS and PRINTED MATERIALS.  Once you have purchased and downloaded an eWorkbook and/or an audio file, you are given the ability to reproduce the content.  Therefore no refunds can be given once the transaction has been made. 

2. For Shipped Products

You have 24 hours from the date you placed your order to cancel your order for a refund, unless otherwise specified during your order processing procedure. All orders are automatically uploaded to our secure merchant processor which incurs fees. If you cancel your order BEFORE it has been shipped, you will be assessed a 10% cancellation fee before credit is issued.After 24 hours, your order is processed.  There is no cancellation of orders AFTER 24 hours of placing your order.  Cancellation of orders after 24 hours will be charged 100% of the total order. No refund will be applied. Damaged products are to be returned for full EXCHANGE.  There are no refunds. Defective materials are to be submitted to Weigh To Health, Inc.  The actual shipping charges which have been incurred by Weigh To Health, Inc. will be deducted from the original purchase before refunds/credits issued. Shipping charges are NOT refundable! All returns will be assessed a service and handling return fee of $10.00 per credit issued. Credits are not issued until the product is received back into our shipping facility. The terms of this guarantee are subject to change with or without notice.  

3. For Nutrition Consultation Services            

(1)  The client is seeking the help of Weigh to Health so that he/she can learn to be healthier. Specifically, to seek information and guidance about heath factors within his/her control: such as eating and lifestyle habits. By optimizing these factors, the client can nourish and support his/her own well being. The client understands that Weigh to Health consultants are certified nutrition consultants NOT physicians; they do not dispense medical advice nor prescribe treatment. The established medical profession may not embrace some evaluation methods, specifically dietary analysis and the more natural approaches to weight loss and optimum health. The client specifically authorizes the use of these analyses so that Weigh To Health may develop an appropriate dietary and health-supporting program for the client. These services are not a substitute for medical care, and are not intended for the diagnosis, treatment, alleviation, or care of disease. For medical diagnosis and treatment of disease, the client agrees to consult a medical physician.   In the event that the client uses the educational information provided by Weigh To Health consultants without a physician's approval, he/she does understand that they are prescribing for themselves, which is their constitutional right.              

(2) The client is responsible for phoning the nutritionist for scheduled appointments and agrees to make all phone calls on time.  If a problem occurs whereby the client cannot make the call, then the client must notify Weigh To Health 24 hours prior to the appointment.  Failure to do so will result in a forfeiture of that week’s appointment and a $15 fee payable by credit card.    

(3) The client agrees to commit to the full length of the program purchased. If the client does not use the purchased amount of sessions within one year from date of purchase, then the remaining sessions will be expired and the program is terminated.              

(4) The client may cancel this agreement, without any penalty or obligation within three days following the date of this contract.  After three days, the program is non-refundable.  To cancel this agreement, mail or deliver a signed and dated notice, which states that you, the client, are canceling this agreement.  This notice shall be sent to Weigh To Health, 10 Jackson Street, Suite 109B, Los Gatos, Ca 95030.  However, if a first consultation has been conducted within the three day time period, the client will be charged $125.00 for that consultation.            

(5) In consideration of the client’s participation in the Weigh To Health program, the client, heirs, personal representatives and assigns, release, waive, discharge and covenant not to sue Weigh to Health, it’s respective directors, officers, employees, volunteers, independent contractors and agents, from any and all claims, liabilities, or damages for personal injuries that the client may suffer directly or indirectly arising out of, relating to, or in any way connected with the client’s participation in the Weigh To Health program.
